Terms and Conditions

ΜΤΝ (“we” or “us”) is providing services which enable you to access ΜΤΝ Mobile TV via the MTN network. By using the Service you agree to be bound by the terms and conditions set out below and any terms and conditions applicable to any other Service that you have selected.
By using this Service, you agree that we may use and share information we hold about you in accordance with Clause 8 below.

1. Access to the Service

1.1 The “Service” means the Mobile TV channel package.
 1.2  In order to use the Service, you must have a compatible mobile phone. We will confirm that your mobile phone is compatible prior to registering for the Service. We will configure your mobile phone in order to be able to access the Service.
1.3  The Service is variable. ΜΤΝ may vary, replace or withdraw programmes, channels, content, and/or any facilities available on the Service without notice. We will tell you if, as a result of any such change, your Subscription Payment changes. The availability of a specific channel does not mean the availability of all programmes of that channel.
1.4  The Service is available over 3G or GPRS network whereas 3G network provides better quality. You can choose to use either 3G or GPRS, depending on their device and the coverage you have available. The quality of the Service might be affected by the network type and the mobile device you are using.
1.5 ΜΤΝ will use reasonable efforts to make the Service available to you at all times. However, you acknowledge due to the nature of mobile telecommunications, it is impossible to provide a fault-free Service and the quality and availability of the Service are affected by factors which might cause the interruption or non-availability of the Service. ΜΤΝ accepts no liability whatsoever for suspension, interruption or non-availability of the Service for any of the reasons set out in clause 1.4 and this clause 1.5.
1.6  MTN reserves the right to change or terminate your use of the Service if you change or terminate your subscription contract or if you cease to be an MTN customer.

2. Payment
2.1 MTN will be charging you monthly for the use of Service.
2.2  We may increase your subscription payment at any time by giving you at least one calendar month’s notice. We may also increase your subscription payment without notice if required by law or if any regulatory authority requests or requires a change to any aspect of our pricing which affects your subscription payment directly or our pricing structure directly.
2.3  If you have missed any payments you owe to MTN, we can suspend provision of the Service to you without giving you notice.

3. Your use of the Service
3.1 You will not use the Service or any part of it other than for personal non-commercial purposes.
3.2 You agree that you will:
3.2.1 provide such proof of your identity as we consider reasonably necessary; and
3.2.2 not use the Services for any improper or unlawful purpose.
3.3   You must not authorise or assist any third party to
3.3.1 copy (except as permitted by law), reproduce, transmit, reverse engineer, decrypt, redistribute or relay the whole of any part of the Service; or
3.3.2 sell or make any charge for watching or using any part of the Service; or
3.3.3 show any part of the Service in public to an audience, even if no charge is made; or
3.3.4 use the Service for any improper or unlawful purpose.
3.4 You agree to follow our reasonable instructions concerning your use of the Service.

4. Liability
4.1 MTN will endeavour to provide the Service using all reasonable care. Except as required by law, we will not be responsible or liable for the fitness for a particular purpose of the Service, or for any loss or damage caused by:
4.1.1 interruption or delay to the Service caused by events outside our reasonable control;
4.1.2 any errors, viruses or bugs contained in the Service caused by events outside our reasonable control;
4.1.3 your negligence or your failure to follow our reasonable instructions;
4.1.4 us or our employees or agents in circumstances where:
(a) there is no breach of a contractual obligation or legal duty of care owed to you by us or our employees or agents;
(b) such loss is not a reasonably foreseeable result of any breach;
(c) or to the extent that such loss or damage results from any breach by you of these terms and conditions;
4.1.5 any incompatibility of the Service with any other software or material on your handset; or
4.1.6 any other factor that is outside our reasonable control.
4.2. MTN does not accept any liability for any content provided by third parties as part of the Service or for any product or service advertised, promoted, offered or sold by third party service providers for use on the Service or otherwise. While all reasonable efforts will be made to ensure that the information contained in the Service provided by us is as accurate as possible, MTN does not accept any liability and makes no representations or warranties in relation to the accuracy or completeness of the information contained in the Service.

5. Copyright, Trademark and Intellectual Property
All copyright, trade marks and all other intellectual property rights in all material or content supplied as part of the Service will remain ours or, where applicable, of our content partners. MTN hereby grants you a licence to use such rights for your personal use of the Service only, in accordance with these terms and conditions.

6. Promotions and Advertising
MTN and/or our business partners may present advertisements or promotional materials on or through the Service. Your participation in any promotional event is subject to the terms and conditions associated with that event. Your dealings with, or participation in promotions by, any third party advertisers on or through the Service are solely between you and such third party. You agree that we shall not be responsible or liable for any loss or damage of any kind incurred by you as a result of any such dealings or as a result of the presence of such third parties on the Service.

7. Termination
7.1 If you are a pay-monthly subscriber you can terminate your registration to the Service at any time giving us notice by calling the  MTN Call Centre at 136 (free of charge when calling from MTN line) or by visiting an MTN Service Centre.  Termination will be effective immediately and you will be charged according to the use of the Service.
7.2  If you are a Pay as you Go subscriber the registration to the Service will be active for a period of thirty (30) days.  If you wish to renew your registration to the Service you need to send a renewal SMS before its expiration. Any monthly fees charged shall not be refunded whether you use the Service or not.
7.3 MTN will be entitled to suspend or terminate your access to any part of the Service at any time should you breach these terms and conditions, or the terms and conditions of any other service MTN may offer you.
7.4   MTN may, at its own discretion suspend or terminate your registration at any time. MTN may do this, for example, to update the service for technical reasons.
7.5   If any of your MTN contracts terminate or are suspended, your access to the Service will also end or be suspended (as applicable) immediately.
7.6  The Service is made available under an agreement between MTN and content providers. If our agreement with content providers ends the Service can no longer be provided to you.

8. Privacy and Personal Information
You confirm that any authorised member of MTN may use and share information we hold about you with other companies in the group for market research and the marketing of MTN's products and services. This may include sending you marketing by email or SMS about MTN Mobile TV or other similar products and services unless you advise us of your preference not to receive such forms of marketing.

9. Changes of terms and conditions.

If we amend these terms and conditions, you will be notified on www.mtn.com.cy.Your first use of the Service after you have been notified of the new terms will constitute acceptance of such changes.
