Terms and Conditions1. This competition is open to all current and future Pay Monthly (“PM”) and Pay As You Go (“PAYG”) subscribers of MTN Cyprus Ltd (“MTN”) excluding employees of MTN, or its agents or any person directly involved with the devising, production, management or marketing of this competition.
2. Participation to the competition presupposes the unconditional acceptance of the competition terms and conditions.
3. All information relating to this competition and published on any promotional material will form part of these terms and conditions of entry.
4. The competition commences on the October 20th, 2009 and ends on the 16th April 2010. Entries received after this date will not be accepted. Entry to the prize draw will be earned according to the use of MTN subscribers’ line (1 entry for every 10 minutes of talk time, 1 entry for every 25 SMS send)
5. Additional Entries will be earned:
(i) Scratch and Win Tickets found inside the new PM and PAYG connection packs. One of the winning prizes will be ten (10) additional entries to the draw. The new subscribers will be requested to send an SMS “FIFA On” to 1313.
(ii) Ring Back Tone (“RBT”) service: PM and PAYG subscribers activating the RBT service during the competition period will collect ten (10) additional entries.
6. Eligible for participation to this competition will be
(i) Existing subscribers of any PM plan including corporate packages (excluding MTN Data Packages) and all active PAYG subscribers. PM and PAYG existing subscribers will be automatically registered in the competition.
(ii) New PAYG subscribers will be automatically registered to the competition upon their first call activation. New PM subscribers will be registered upon contract activation.
(iii) PAYG and PM subscribers will be able to withdraw from the competition by sending SMS “FIFA OFF” to 1313 or by calling 136. Registering back to the competition can be done only by calling 136.
7. An SMS will be sent to all subscribers informing them about their entrance in the competition.
8. Only SIM cards with active status on the date of the draw will be entitled to participate to the draw competition.
9. In the event of a change of GSM number, the entries will be transferred to the new number. Entries generated by a PM account are not transferable to a PAYG account and vice versa.
10. If a SIM card is lost, entries earned by the subscriber will be transferred to the new SIM card provided to the subscriber.
11. In the event of transfer of ownership of a SIM card, the entries earned will not be transferred to the new subscriber.
12. Entries balance can be obtained by calling 136 or send an SMS “FIFA STATUS” to 1313.
13. There will be three (3) draws on 24/12/2009, 15/02/2010 and 16/04/2010. Two winners will be selected per draw at random from all eligible entries. Each winner will have to answer correctly to one question. After each draw, entries earned will be zeroed and new entries will be earned for the next draw upon usage of the line.
14. Prizes available for the entrants will be:
(i) Two winners will be selected per draw. The winners will win one game ticket for any game of the FIFA world cup 2010. The winners will be notified at the date of the prize draw of the game that they will attend. Each winner must be in compliance with all terms and conditions of this competition to be awarded a prize. The winners must appear with their legal guardian if minors and the prize will be awarded to that person’s legal guardian.
(ii) New subscribers using the Scratch and Win tickets will be able to win FIFA promotional gifts, handsets, cameras, laptops, gaming consoles and other gifts mentioned in the Scratch and Win tickets. The winner must present the Scratch and Win ticket to an MTN shop for validation of its authenticity. It will be the sole responsibility of the Scratch and Win card winner to visit an MTN shop to claim his prize until the 16/07/2010. The winners must appear with their legal guardian if minors and the prize will be awarded to that person’s legal guardian.
MTN reserves the right to provide substitute prizes of similar value should the specified prizes becomes unavailable for reasons beyond its control. Cash or credit alternatives will not be offered. Prizes are not transferable. In the event of fraud, abuse, and/or an error affecting the proper operation of the competition, including the allocation of more prizes than are available, MTN reserves the right to end or suspend the competition; amend these terms & conditions; declare void the notification of winners; and/or to allocate available prizes by conducting a simple draw from all wrongly allocated winners.
15. The draw winners will be informed by MTN and asked to answer a question in order to win one of the prizes. If they give the right answer they will be informed when to visit MTN Head Office in Nicosia in order to claim their prizes. For verification purposes the winners must present their ID. The winners must appear with their legal guardian if minors. If the prize is unclaimed or declined within three days, then alternate winners will be selected from the draw. The prize is strictly personal and cannot be transferred in any way. MTN will not be responsible for any inability of the prize winners to take up the specified prizes.
16. In the event the draw winner ceases to be an MTN subscriber within the competition period and/or during the Fifa World Cup 2010 his entries will be zeroed and she/he will be unable to participate in the competition and claim any prize.
17. By accepting to receive any of the prizes the winners give full permission to MTN to publicize their names, age and town of residence in any promotional activity around the competition on any media selected. This promotional activity is not limited to the use of their name alone, but may include the use of their image by way of photography or film.
18. MTN reserves the right to cancel, terminate or alter this competition or any term of this competition (including any prize) at any time and without notice and shall not be liable for any claims whatsoever arising out of such cancellation and/or termination and/or alteration. MTN further reserves the right to terminate immediately this competition and without notice in the event that the competition is held to become or becomes unlawful.
19. If any provision of these terms and conditions is held invalid by any law, rule, order or regulation of any government, or by the final determination of any court of a competent jurisdiction, such invalidity shall not affect the enforceability of any other provisions not held to be invalid.
20. Neither MTN nor any other person or party or affiliate associated with MTN or any of MTN’s agents shall be liable for any loss or damage whatsoever incurred or suffered or any personal injury suffered or sustained in connection with any prize offered.
21. Neither MTN nor any other person or party or affiliate associated with MTN or any of MTN’s agents shall be responsible for any lost, delayed or misdirected entries, including entries that were not received due to any failure of hardware, software or other technical systems. MTN accepts no responsibility for incorrectly completed lost or delayed notices, acceptances, tickets or other documents related to the prizes.
22. MTN assumes no responsibility for cancellation of the competition due to a force majeure clause.
23. MTN’s decision is final and no correspondence will be entered into.
24. MTN assumes no responsibility to any of its subscribers in relation to this competition after its termination.
25. This competition is governed by Cypriot Law.
