Terms and Conditions The programme rewards you, our customer, for your loyalty. Operator and organiser of the programme is Areeba Limited (“MTN”). The following is a summary of the terms and conditions governing points accrual, award redemption and general procedures. Special rules may apply as set out in further programme documents or in the MTN Rewards communication media (e.g. newsletter, awards catalogue, account statement.
1. Membership 1.1. Eligibility Membership is limited to all active MTN Pay Monthly subscribers. 1.2. Commencement of membership Membership commences upon enrolment, when an account is opened with MTN Rewards. Only one account per contract number may be opened. There is no legal entitlement to join the MTN Rewards programme. MTN reserves the right to reject applications without giving reasons. Members are deemed to have fully and unconditionally accepted these terms and conditions by enrolling in the programme. 2. Points 2.1. General The basis of calculation for the MTN Rewards programme is the points credited to the member’s account. Points may be used only for the purposes explicitly stated in the terms and conditions or in the MTN Rewards communication media. Points and the accounts are non-transferable, and no cash disbursement is possible. Members cannot transfer in any way or assign points to any third party, or combine them with the points of another member in order to jointly receive an award. 2.2. Account balance MTN will be sending information on points accrued on a monthly basis through SMS and the monthly invoice. Members may check their current point account balance at MTN Points of Sale, MTN Customer Care, or via SMS request. SMS request by Member will be charged. Claims based on discrepancies must be filed within one week of receiving the account information. Thereafter, the account balance as stated is considered approved. 2.3. Points accrual Points may be earned from the commencement of membership. The number of points credited depends on the programme conditions valid at the time of utilisation of the service. For all services eligible for points accrual that have taken place in the period between the application for membership and the opening of the personal account, no points will be credited. 2.3.1 Other ways to earn points Other ways to earn points and the relevant conditions are announced separately in the MTN Rewards communication media. 2.3.2 Exclusions from point credit No points are credited for free services, or services for which the member receives benefits under another bonus programme. Certain other services may also be excluded from point accrual following a prior announcement in the MTN Rewards communication media. 2.3.3 Crediting procedure. Crediting of points to a member’s account is automatic as long as the Member has fully settled any due balances with MTN. 2.4 Points redemption 2.4.1 General Members may redeem their points as soon as they have accrued at least 1,000 points, subject to 2.4.2 and 2.4.4. Award offers and the specific number of points required in each case are stated in the various MTN Rewards communication media. Points may be redeemed only at MTN’s Points of Sale. 2.4.2 Award Gifts Awards are subject to availability and stock at the moment of redemption. No awards can be ordered or reserved.2.4.3 Other awards Other awards if any, their conditions and further ways to redeem points will be announced separately in the MTN Rewards communication media. 2.4.4 Award conditions A Member may redeem points as long as all due balances with MTN have been fully settled. 2.5. Points expiry Any points not redeemed within 24 months will expire. The 24-month period commences on the date of invoice, which corresponds, to the usage of services that generated the specific points. 2.6 Account Freeze Members that are barred-out, suspended or in a credit limit status will not be able to redeem their points. While an account is suspended, the Member will not be eligible to receive any bonus points that might be given by MTN. No claims shall be asserted by the Member against such freezing of an account. 2.7 Loss of Points The points accrued by a Member will be lost: a) if not redeemed within two years as provided in 2.5 b) if MTN services have been suspended to the Member for two repetitive times. c) If the Member terminated its membership without redeeming the points d) If MTN terminates the Member for a material breach of these terms or any other terms of MTN services.
3. Breach of terms and conditions, termination of contract, programme amendments Notice of termination, suspension, exclusion from membership 3.1 The Member may give notice at any time to terminate membership without observing a period of notice. Termination of membership is automatic if the Member’s subscription to MTN services is terminated. Any accrued points must be redeemed prior or immediately upon termination. 3.2 Termination by MTN of the Member’s account for material cause is without notice as provided herein and in accordance with 2.7. Termination without notice by MTN and exclusion from membership shall have future effect. Once MTN has terminated a membership, renewed participation in MTN Rewards is no longer possible. These terms and conditions continue to govern the winding up of the membership following termination. 3.3. Programme termination MTN reserves the right to cancel the MTN Rewards programme at any time or replace it with another programme and to duly terminate the membership contracts. 4. Miscellaneous 4.1. Liability MTN’s responsibility against its Members in relation to MTN Rewards is limited. MTN, under no circumstances, including also negligence, shall be liable, for any damage, (including also consequential damages) resulting from the use of or the implementation of MTN Rewards. In any case, MTN’s total liability whether contractual, tort or other, for all damages, losses, costs and expenses under whatever causes of action or omission, shall be limited, solely and exclusively, to the re-crediting of the Member’s Account with the corresponding points of the disputed offer. MTN has no responsibility for consequential damages. 4.1.1 MTN has no responsibility for any mistakes, omissions or alterations of the text and contents of the present terms and conditions during the printing of this document or other documents relative to the MTN Rewards Programme. 4.2. Data protection Personal data relating to participation in the programme is processed and used for purposes serving programme implementation. For advertising or promotional purposes, data may be transmitted to partner companies and other third parties to the extent to which the member has consented in his/her registration with MTN Rewards. 4.3. Changes to the programme, amendments to the terms and conditions MTN reserves the right to alter or amend the membership terms and conditions, the awards, award scales or any other procedures described in the programme documents at any time, wherever such changes are considered necessary. No claims may be asserted against MTN based on changes required by statutes. Members shall be notified of any changes or amendments to these terms and conditions. 4.4 Applicable law, jurisdiction These terms and conditions shall be governed by the laws of the Republic of Cyprus. 4.5. Severability clause In the event that any provisions of the above arrangements are legally invalid either wholly or in part, this shall not affect the validity of the remaining provisions. The parties hereto undertake to replace any invalid, incomplete or missing provision with a provision that customarily approximates as closely as possible to the commercial intentions of the parties. |
